Humanitarian Temporary Release: When Does It Apply?

Learn when humanitarian temporary release can apply under Korean Immigration Law, including special circumstances that may be considered.

 


Kababayan, in this article I want to talk about a version of temporary release that's a little different from the standard process — humanitarian temporary release, or what's often referred to as 인도적 차원의 임시해제.

This type of release is meant to address situations where continuing detention would cause serious hardship because of special circumstances — for example, a serious medical condition, pregnancy, a family emergency, or a situation involving the need to care for young children who have no one else to look after them.

In these humanitarian cases, the immigration office has more flexibility to grant temporary release faster or under more lenient conditions than the standard process, because the priority becomes addressing a genuine and urgent human need — not just weighing flight risk the way it normally would.

That said, "humanitarian" doesn't mean automatic. The person requesting this type of release, or their family or representative, still needs to clearly explain and, where possible, provide documentation of the circumstances — such as a medical certificate for a health condition, or proof of a family situation requiring urgent attention.

I've personally seen how important this provision can be. I remember helping community members navigate situations where a detained parent was desperately worried about young children left with no proper care back home or here in Korea — and understanding that humanitarian release exists gave them a real path to explore, instead of just feeling stuck and hopeless.

If you believe your situation, or that of a loved one, qualifies for humanitarian consideration, don't hesitate to raise this directly with the immigration office, and gather whatever documentation you can to support the request. It's always worth asking, even if you're not sure you qualify.
