General Detention vs Emergency Detention: What's the Difference?

Learn the difference between general detention (일반보호) and emergency detention (긴급보호) under Korean Immigration Law.


 In my previous article, we talked about what "보호" or detention means in immigration law. Now I want to explain its two main types: 일반보호 (general detention) and 긴급보호 (emergency detention).

General Detention (일반보호) — this is the normal detention process. It requires a detention order (보호명령서) to be issued first before you can be held or taken to a detention facility. In other words, there's proper documentation and process followed before you're detained.

Emergency Detention (긴급보호) — this is only used in urgent situations, where there isn't enough time to wait for the normal process because there's a serious risk the person might flee or disappear. In this case, you can be held even before a formal detention order is issued — but this has a time limit, and it still needs to be followed by the proper process afterward.

Why does this matter to know? Because if you or someone you know was suddenly detained with no prior notice, it was most likely an emergency detention. You still have rights here — being an emergency doesn't mean there's no law being followed anymore. The immigration office is still required to provide proper documentation and process within a set period of time after an emergency detention.

The important thing to remember is: no matter which type of detention was used on you, you still have the right to file a 이의신청, or appeal, against the detention order. You shouldn't just accept a situation if you feel it was unfair or that the process was done incorrectly.
